California calculates spousal support in two phases. This amount is calculated by a computer program based on various data, such as each party’s income, income tax filing status and other factors. At the end of your case, the second phase of spousal support will be determined by the marital standard of living which also includes several factors, and is typically lower than that of temporary support. Divorce does not have to end in financial disaster. California is a community property state which means that all property acquired during the marriage is presumptively community property and will be divided equally upon divorce, unless otherwise agreed.
